1. Acceptance of Terms
By creating an account or using RadarOps in any way, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the service.
2. Age Requirement
You must be at least 18 years of age to create an account or use RadarOps. By registering, you confirm that you are 18 or older. We reserve the right to terminate any account where we have reason to believe the user is under 18. The service is not directed at minors.
3. Nature of the Service
RadarOps is a market data analytics platform. It collects, processes, and displays publicly available market data across multiple timeframes in a structured, readable format. The platform helps traders organise and interpret raw market data for their own independent decision-making. RadarOps does not provide financial advice, investment advice, trading recommendations, or advice to buy or sell any asset. We are a data tool, not an advisory service.
4. No Financial Advice
Nothing on RadarOps — including scanner output, alert ratings, timeframe data, in-play scores, direction indicators, or any other feature — constitutes financial advice, investment advice, a solicitation, or a recommendation to trade any financial instrument or asset. All information is provided purely for informational and analytical purposes.
Trading and investing involve substantial risk of financial loss. Past data patterns are not indicative of future results. You are solely and entirely responsible for all trading and investment decisions you make. RadarOps accepts no responsibility for any losses you incur.
Before making any financial decision, you should consider seeking independent financial advice from a qualified adviser licensed under the applicable law in your jurisdiction.
5. Regulatory Disclaimer
RadarOps is incorporated in Victoria, Australia. We are not authorised or regulated by any financial regulatory authority, including but not limited to:
• The Australian Securities and Investments Commission (ASIC)
• The Financial Conduct Authority (FCA)
• The Securities and Exchange Commission (SEC)
• Or any equivalent regulatory body in any jurisdiction.
We do not hold an Australian Financial Services Licence (AFSL) and do not provide financial product advice as defined under the Corporations Act 2001 (Cth). We are not a financial adviser, broker, dealer, or investment manager.
If you require regulated financial advice, please consult a qualified financial adviser who holds the appropriate licence or authorisation in your jurisdiction. In Australia, you can verify a financial adviser's licence at moneysmart.gov.au.
6. Free Trial — 7-Day Command Access
All new accounts automatically receive a 7-day free trial of Command tier access. During this period:
• No payment or credit card is required.
• You have full access to all Command features including real-time data, unlimited Telegram pings, and all nine timeframes.
• After 7 days, your account reverts to the Recon (free) tier unless you upgrade to a paid plan.
• This trial is available once per person. Abuse of the trial system — including creating multiple accounts to obtain repeated trials — is a violation of these terms and may result in account termination.
We reserve the right to modify or discontinue the free trial offering at any time for new registrations.
7. Paid Plan Trial — 14-Day Trial with Card
Paid plan subscriptions (Tactical and Command) may include a 14-day free trial period. Where offered:
• A valid payment method is required to start the trial.
• You will not be charged during the 14-day trial period.
• If you do not cancel before the trial ends, your payment method will be charged at the applicable subscription rate.
• You may cancel at any time during the trial from your account dashboard — you will not be charged.
This trial offering is subject to availability and may not be available in all circumstances.
8. Subscription & Payments
Paid plans are billed on a recurring basis (monthly or annually depending on your selected plan) via Stripe. By subscribing, you authorise us to charge your payment method automatically at the start of each billing period until you cancel.
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain access until that date. No refunds are issued for the unused portion of a billing period.
9. Refund Policy
We do not offer refunds on paid subscription fees. All sales are final after the applicable trial period.
If you believe you have been charged in error, contact us at [YOUR CONTACT EMAIL] within 14 days of the charge and we will investigate.
Australian Consumer Law (ACL) rights: If you are an Australian consumer, you have rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded by these terms. Where liability cannot be excluded under the ACL, our liability is limited to resupplying the service or the cost of having the service resupplied, at our option. Nothing in this clause limits any right or remedy you have under the ACL that cannot lawfully be excluded.
10. Australian Consumer Law
If you are an Australian consumer, the following applies to you:
• Our services come with consumer guarantees under the Australian Consumer Law (ACL) that cannot be excluded.
• Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the ACL.
• To the extent our liability cannot be excluded under the ACL, our liability is limited to: (a) in the case of services — resupplying the services or paying the cost of having the services resupplied.
• You may contact the Australian Competition and Consumer Commission (ACCC) at accc.gov.au or call 1300 302 502 if you believe your ACL rights have been breached.
• You may also contact your relevant state or territory consumer protection agency.
11. Acceptable Use
You may not use RadarOps to redistribute, resell, sublicense, or share access to the service with others. You may not scrape, copy, reverse-engineer, or systematically extract data from our platform. You may not attempt to circumvent access controls, overload our systems, abuse the trial system, or access features outside your subscription tier. Violation of these terms may result in immediate account termination.
12. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We strongly recommend enabling two-factor authentication (2FA). You must notify us immediately at [YOUR CONTACT EMAIL] if you suspect unauthorised access to your account. We are not liable for losses resulting from failure to secure your credentials.
13. Intellectual Property
All content, software, design, and data on RadarOps — including but not limited to the scanner logic, user interface, and brand assets — is owned by or licensed to RadarOps. You are granted a limited, non-exclusive, non-transferable licence to access and use the service for personal, non-commercial purposes during your active subscription. No other rights are granted.
14. Service Availability
We aim for high availability but do not guarantee uninterrupted or error-free service. We are not liable for losses, missed opportunities, or damages arising from downtime, delays, data inaccuracies, or interruptions. The service is provided on an "as is" and "as available" basis.
To the extent permitted by law (including the ACL), we exclude all implied warranties, conditions, and guarantees except those which cannot be excluded by law.
15. Limitation of Liability
To the maximum extent permitted by applicable law — including the Australian Consumer Law — RadarOps, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including trading losses, lost profits, or data loss — arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.
Nothing in this clause excludes, restricts, or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded.
16. Indemnification
You agree to indemnify and hold harmless RadarOps and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the service, your violation of these terms, or your trading activity. This indemnification does not apply to the extent that a claim arises from our own negligence, fraud, or breach of any non-excludable consumer guarantee under the Australian Consumer Law.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia, and the Commonwealth of Australia.
You irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and the Federal Court of Australia in relation to any dispute arising under or in connection with these Terms or your use of the service.
Nothing in this governing law clause limits any mandatory rights you have under the laws of your country of residence.
18. Termination
We reserve the right to suspend or terminate your account at any time if you violate these terms, engage in fraudulent activity, or abuse the platform — including abuse of the free trial system.
You may delete your account at any time from your account settings or by contacting us at [YOUR CONTACT EMAIL].
If we terminate your account without cause, we will refund any unused portion of your current billing period on a pro-rata basis.
19. Dispute Resolution
We encourage you to contact us first at [YOUR CONTACT EMAIL] to resolve any disputes informally. We will endeavour to respond to complaints within 30 days.
If a dispute cannot be resolved informally, Australian users may:

• Apply to the Victorian Civil and Administrative Tribunal (VCAT) for disputes within its jurisdiction
Note: RadarOps does not hold an Australian Financial Services Licence and is not a member of the Australian Financial Complaints Authority (AFCA). AFCA handles complaints about licensed financial services providers; it does not have jurisdiction over RadarOps.
20. Changes to Terms
We may update these Terms at any time. If changes are material, we will notify you by email at least 14 days before they take effect. Continued use of the service after changes take effect constitutes your acceptance of the updated Terms.
